1. Introduction

Quarlo Software LLC ("Quarlo," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our service.

This policy applies to all content hosted on Quarlo, including user-contributed interview questions, experiences, tips, and other materials.

3. Filing a DMCA Takedown Notice

If you believe that content on Quarlo infringes your copyright, please send a written notification to our designated agent containing the following information:

  1. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL of the page containing the material).
  3. Your contact information, including your name, address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature (typing your full legal name is acceptable as an electronic signature).

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

4. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our designated agent containing:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, any judicial district in which Quarlo may be found), and that you will accept service of process from the person who provided the original notification or an agent of such person.
  4. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within 10-14 business days that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material.

5. Repeat Infringer Policy

Three Strikes Policy

Quarlo will terminate the accounts of users who are repeat infringers of copyright.

Our repeat infringer policy operates as follows:

  • First valid DMCA notice: Warning sent to user, infringing content removed
  • Second valid DMCA notice: Final warning sent to user, infringing content removed, account placed on probation
  • Third valid DMCA notice: Account permanently terminated

We reserve the right to terminate any account at any time for egregious infringement, even on the first offense.

6. Our Response to DMCA Notices

Upon receiving a valid DMCA takedown notice, we will:

  1. Remove or disable access to the allegedly infringing material
  2. Notify the user who posted the content that it has been removed
  3. Provide the user with a copy of the takedown notice
  4. Inform the user of their right to file a counter-notification
  5. Record the incident for purposes of our repeat infringer policy

We aim to process valid DMCA notices within 2-5 business days.

7. Modifications to This Policy

We may update this DMCA Policy from time to time. We will notify users of any material changes by posting the new policy on this page with an updated effective date.
